These Terms & Conditions of Sale ("Terms") govern all purchases made through the Melwi online store and website (the "Website"), operated under the trade name Melwi by:

Hereinafter referred to as "Melwi," "we," "us," or "our."
The person placing an order through the Website is referred to as the "Customer," "you," or "your."

By placing an order through the Website, you acknowledge that you have read, understood, and agreed to these Terms.

1. Purpose

These Terms govern the sale of products offered by Melwi through its Website.

Melwi specializes in products designed to enhance the comfort, well-being, and environment of cats, including the Ondine cat water fountain.

These Terms apply to all orders placed through the Website.

2. Products

The products available for purchase are those displayed on the Website, subject to availability.

Melwi makes reasonable efforts to ensure that product descriptions, specifications, photographs, and other information displayed on the Website are accurate and up to date.

Product photographs and illustrations are provided for informational and presentation purposes. Minor differences in appearance may occur depending on screen settings, lighting conditions, photography, or other circumstances.

The essential characteristics of each product are presented on its product page before the Customer places an order.

3. Prices

Product prices are displayed on the Website at the time the order is placed.

The price applicable to an order is the price displayed at the time the Customer confirms the order.

Unless otherwise stated on the Website, standard shipping costs are included in the displayed price.

For international orders, including orders shipped to the United States and the United Arab Emirates, additional taxes, customs duties, import fees, or other charges may apply depending on the destination country and its applicable laws.

Unless expressly stated otherwise at checkout, any customs duties, import taxes, local taxes, or similar charges imposed by the destination country are the responsibility of the Customer.

Melwi is not responsible for charges imposed by customs or tax authorities in the destination country.

4. Ordering

Customers may place orders directly through the Website.

Before completing an order, the Customer has the opportunity to review the products selected, the total price, shipping information, and other relevant order details and to correct any errors.

By confirming the order, the Customer agrees to these Terms and acknowledges that the order creates an obligation to pay.

An order becomes final once payment has been successfully authorized and confirmed, subject to product availability.

An order confirmation will be sent to the email address provided by the Customer.

Melwi reserves the right to refuse or cancel an order in circumstances including, but not limited to:

• the product being unavailable;
• an obvious pricing or product description error;
• suspected fraudulent activity;
• payment failure or authorization issues;
• unusual or abusive ordering activity; or
• any attempt to circumvent the Website's terms or security measures.

If an order that has already been paid for is cancelled by Melwi, the corresponding amount will be refunded to the Customer.

5. Payment

Payment is due in full at the time the order is placed.

Available payment methods are those displayed on the Website at checkout.

Payments may be processed through Shopify and/or its authorized payment service providers.

Melwi does not intentionally store complete payment card information.

An order may only be processed and shipped once payment has been successfully confirmed.

6. Shipping and Delivery

Melwi ships to destinations made available at checkout.

Estimated delivery times are displayed on the Website or during the checkout process.

Delivery times may vary depending on:

• the destination country;
• the carrier;
• customs clearance procedures;
• weather conditions;
• public holidays;
• exceptional events; or
• circumstances beyond Melwi's reasonable control.

Melwi will provide the delivery timeframe applicable to the order in accordance with applicable law.

Where no specific delivery period has been agreed, the delivery will take place within the period required by the applicable consumer protection laws.

Melwi is not responsible for delays caused by incorrect, incomplete, or inaccurate delivery information provided by the Customer.

The Customer is responsible for ensuring that the delivery address provided at checkout is accurate and complete.

7. Receipt of Products

Upon receiving a package, the Customer is encouraged to inspect the package and product for any visible damage.

If the product is damaged, defective, or does not correspond to the order, the Customer should contact Melwi as soon as reasonably possible at: melwishopus@gmail.com

The Customer may be asked to provide photographs, videos, or other information documenting the issue.

This request is intended to facilitate the handling of the claim and does not limit any mandatory legal rights available to the Customer.

8. Right of Withdrawal / Cancellation

Where French consumer law applies, consumers generally have a 14-day withdrawal period for distance purchases, without having to provide a reason.

For the purchase of physical goods, the withdrawal period generally begins on the day the Customer, or a third party designated by the Customer other than the carrier, takes physical possession of the goods.

For orders containing multiple products delivered separately, the withdrawal period may begin when the last product is received.

Exercising the right of withdrawal

To exercise the right of withdrawal, the Customer must notify Melwi of their decision before the applicable 14-day period expires.

The Customer may use the withdrawal form provided at the end of these Terms, although use of the form is not mandatory.

After notifying Melwi of the withdrawal, the Customer must return the product within the applicable legal period, generally 14 days from the date on which the withdrawal decision was communicated.

The product should be returned securely and appropriately packaged to prevent damage during transportation.

Where permitted by applicable law, the Customer may be responsible for any decrease in the product's value resulting from handling beyond what is necessary to establish the product's nature, characteristics, and functionality.

Return shipping costs

Unless otherwise stated by Melwi or required by applicable law, the Customer is responsible for the direct cost of returning a product when exercising the right of withdrawal.

International return shipping costs may be significant depending on the Customer's location.

Refunds

Where a valid right of withdrawal is exercised, Melwi will refund the amounts required by applicable law.

Where required by applicable law, the refund will include the cost of standard initial delivery.

Melwi may delay the refund until the returned product has been received or until the Customer provides evidence that the product has been shipped back, whichever occurs first, where permitted by applicable law.

Refunds will generally be made using the same payment method used for the original transaction, unless the Customer expressly agrees otherwise and applicable law permits such alternative.

9. Legal Warranties

Where French law applies, consumers benefit from mandatory statutory warranties, including:

• the legal guarantee of conformity; and
• the legal guarantee against hidden defects.

These legal warranties apply independently of any optional commercial warranty that may be offered.

Nothing in these Terms is intended to exclude, restrict, or waive any mandatory consumer rights or statutory warranties applicable to the Customer.

Melwi may request reasonable information necessary to assess the claim, including a description of the issue and photographs or videos of the product.

10. Product Use and Safety

The Customer agrees to use the product only for its intended purpose and in accordance with any instructions, safety information, and maintenance recommendations supplied with the product.

The Customer is responsible for following all applicable instructions concerning installation, cleaning, maintenance, and use.

Melwi is not responsible for damage caused by misuse, improper installation, unauthorized modification, negligence, or failure to follow the product's instructions, except where such limitation is prohibited by applicable law or would affect mandatory consumer rights.

11. Liability

Melwi is responsible for fulfilling its contractual obligations in accordance with applicable law.

Melwi shall not be liable for delays or failures resulting from circumstances beyond its reasonable control, including events that qualify as force majeure under applicable law.

Nothing in these Terms limits any mandatory rights or remedies available to consumers.

12. Intellectual Property

All content appearing on the Website, including but not limited to:

• text;
• photographs;
• product images;
• illustrations;
• logos;
• graphics;
• videos;
• designs;
• trademarks;
• brand elements; and
• other original content

is protected by applicable intellectual property laws.

Unless expressly authorized in writing by Melwi, no part of the Website or its content may be copied, reproduced, modified, distributed, published, or commercially exploited.

The Melwi name, branding, visual identity, and original content may not be used without prior written authorization.

13. Personal Data and Privacy

Personal information collected during an order is processed in accordance with Melwi's Privacy Policy.

Personal information may be processed for purposes including:

• processing and fulfilling orders;
• communicating with Customers;
• processing payments;
• providing customer service;
• managing returns and refunds;
• handling warranty claims; and
• complying with legal and regulatory obligations.

14. Retention of Title

Where permitted by applicable law, products remain the property of Melwi until the purchase price has been paid in full.

Transfer of risk occurs in accordance with the mandatory provisions of applicable law.

Melwi aims to respond to customer inquiries within a reasonable timeframe.

16. Consumer Mediation

Where required by French law, consumers may have access to a consumer mediation procedure after first submitting a written complaint directly to Melwi and attempting to resolve the dispute amicably.

Melwi is in the process of designating an approved consumer mediator in accordance with French law. Once a mediator has been designated, its name, address, and website will be published on this page and communicated to Customers upon request.

In the meantime, Customers are invited to contact Melwi directly at melwishopus@gmail.com to seek an amicable resolution to any dispute.

17. Governing Law and Dispute Resolution

These Terms are governed by French law, without prejudice to any mandatory consumer protection provisions that may apply in the Customer's country of residence.

Melwi will make reasonable efforts to resolve customer complaints amicably.

Nothing in these Terms prevents a consumer from exercising any mandatory rights or remedies available under the laws applicable to their situation.

The competent courts shall be determined in accordance with applicable mandatory jurisdiction rules.

18. Changes to These Terms

Melwi may update these Terms from time to time, including to reflect changes to its products, services, business practices, or applicable laws.

The Terms applicable to an order are those accepted by the Customer at the time the order is placed.

The current version of these Terms will be made available on the Website.
